 Statelessness and Human Rights: the role of the United Nations High Commissioner for Refugees (UNHCR).

Resumen

La apatridia, la condición de no ser nacional de ningún Estado, es una de las más serias pero desconocidas violaciones a los Derechos Humanos y por esa razón las Naciones Unidas se han visto crecientemente motivadas para enfrentar este problema. Los instrumentos internacionales más importantes sobre el tema de la apatridia son la Convención sobre el estatuto de los apátridas de 1954 y la Convención para reducir los casos de apatridia de 1961. Si bien estas convenciones no imponen obligaciones excesivas a los Estados parte, sólo unos pocos Estados las han ratificado: 66 la primera y 38 la segunda. Sin embargo, en las últimas décadas ha habido importantes actuaciones de la Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR) –la autoridad competente sobre esta materia en el Sistema de Naciones Unidas– relacionadas con la apatridia. El trabajo del ACNUR sobre apátridas se desarrolla alrededor de cuatro áreas fundamentales: identificación, prevención, reducción y protección. Con el apoyo del ACNUR algunos Estados como Sri Lanka (antiguo Ceilán), Estonia y Letonia han logrado reducir los casos de apatridia y de esta manera han mejorado la situación de los Derechos Humanos en estos países.

Abstract​​

Statelessness, the condition of not being a national from any State, is one of the most serious but unknown violations of Human Rights, and that is the reason why the United Nations have been increasingly motivated to deal with this problem. The most important instruments of international law related to the statelessness issue are the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. Even though these Conventions do not impose excessive obligations to the States, they have been ratified by only a few States: 66 the former and 38 the latter. However, in the past decades there has been a very important action of the United Nations High Commissioner for Refugees (UNHCR) –the competent authority in the matter within the UN System– related to statelessness. The work of the UNHCR towards stateless people has the following key areas: identification, prevention, reduction and protection. With the support of the UNHCR, some States like Sri Lanka (former Ceylon), Estonia and Latvia have been able to successfully reduce the cases of statelessness and in this way they have improved the Human Rights situation in these countries.

 International Law and Middle East Family Law: Conciliating the Irreconciliable

Abstract

International Law has been shaped by the western family law tradition and so are the institutions that regulate the interaction of the international community. The fact that this set of rules has been created by a group of states with a determined set of mind different in many crucial aspects to more that the other half of the world’s population is a major cause of conflict. The role of some of the international organizations is affected by the attempt of some states to homogenize the International System, the reaction this provokes on the states which are some how obliged by the system itself to converge in some matters  by nature irreconcilable with the western perspective.

Resumen

El derecho internacional ha sido moldeado por la tradición de la familia del derecho occidental, al igual que las instituciones que regulan las interacciones de la comunidad internacional. El hecho de que este conjunto de reglas haya sido creado por un grupo de Estados bajo una óptica diferente en varios  aspectos cruciales al de laotra mitad de la población mundial, es una causa de conflicto. El rol de algunas de las organizaciones internacionales se ve afectado por el intento de algunos Estados de homogenizar el sistema internacional, provocando una reacción en aquellos Estados que de alguna manera se ven obligados por el sistema a converger en asuntos que por su naturaleza son irreconciliables con la perspectiva de occidente.

 Transboundary pollution, pollution, development and enviromental damage.

Abstract

Currently, it is apparent how the environment has become a fundamental issue of the interdependence situation that characterizes the current world system. This tendency involves the emergence of new responsibilities, positions and conditions for actors such as states, multinational corporations, International Organizations and NGOs, among others.
Regarding thisframework, perhaps one of the major challenges that countries face when they interact with each other is the process of environmental pollution and damage to neighbors. Beyond the debate around the concept of transboundary pollution and its pertinence today, because of their characteristics, developed and developing countries are called to play a specific role in the global environmental scenario.

This paper analyzes the environmental dimension of the international system current context, in order to understand the role of the transboundary pollution responsibilities and evolution in the entire world, to define the main elements, interests concerns and challenges behind its participation, and how this process can contribute to the political and economic positioning of many countries on the international system.

Resumen

En la actualidad, es evidente cómo el medio ambiente se ha convertido en una cuestión fundamental de la situación de interdependencia que caracteriza el actual sistema mundial. Esta tendencia implica la aparición de nuevas responsabilidades, posiciones y condiciones para los actores como los estados, corporaciones multinacionales, organizaciones internacionales y ONGs entre otras. En relación con esta estructura, quizás uno de los principales retos que enfrentan los países cuando interactúan entre ellos es el proceso de contaminación ambiental y daños a los vecinos. Más allá del debate en torno al concepto de contaminación tranforonteriza y su pertinencia actual, debido a sus características, los países desarrollados y en desarrollo estás llamados a desempeñar un papel especifico en el escenario del medio ambiente mundial.
Este trabajo analiza la dimensión ambiental del contexto del sistema internacional actual, con el fin de comprender el papel de los deberes en cuanto a contaminación transfronteriza y su evolución en el mundo, para definir los elementos principales, se refiere a los intereses y desafíos que plantea su participación, y cómo este proceso puede contribuir al posicionamiento político y económico de muchos países en el sistema internacional.

 Los casos de Colombia ante la OMC

Abstract

The Dispute Settlement Body of the WTO has settled disputes among members of the organization for the past 21 years. At this time Colombia has participated as a plaintiff in 5 cases and a defendant in another 3, aside from a third party in the same. The article discusses cases in which Colombia was partly based on information available to the public.

El Órgano de Solución de Diferencias de la OMC ha dirimido las disputas entre los miembros de la organización por los últimos 21 años. En este tiempo Colombia ha participado como demandante en 5 casos y como demandado en otros 3, además de intervenir como tercero en otro tanto. El artículo analiza los casos en los cuales Colombia fue parte, a partir de  información disponible al público.

 Estatuto de Roma en la comunidad internacional

Resumen

La creación de diferentes organizaciones internacionales se ha presentado ante un proceso de globalización e interés común, frente a circunstancias trascendentales para los Estados, ejemplo de ello es la creación de las Naciones Unidas, en cuyo seno se discuten temas fundamentales como la paz y seguridad internacionales, entre muchos otros. Desde la creación de la organización mencionada, se hizo manifiesta la carencia de un orden global, a través del cual se abarcaran asuntos de suma importancia para la comunidad internacional, como lo son los crímenes que afectan a la comunidad en su conjunto, así como la imputación de responsabilidades y resarcimiento de víctimas. La Corte Penal Internacional, a través de su texto constituyente, el Estatuto de Roma, es la respuesta a aquellas problemáticas. Es importante, fuera de tener conocimiento frente al órgano relacionado, ahondar en el curso de toma de decisiones en estos espacios, para identificar las falencias, presentes no sólo en los márgenes de impunidad, sino también en la selectividad y falta de democracia en órganos donde se debería difundir dicho sistema. 

Abstract

The creation of different international organizations arose within a globalization process and common interest frame, regarding to transcendental circumstances for the States, an example of it, is the creation of the United Nations where discussions about fundamental issues have taken place, as international peace and security, among others. Since the creation of the UN, the lack of a global order arose, trough which important discussions for international community should take place, such as crimes that affect the community as a whole, as well as the imputation of responsibilities and victim´s compensation. The Rome Statute of the International Criminal Court is the answer to those scourges. It is important to highlight, not only the knowledge regarding the judicial body, but also the decision making process in this framework, specially to be able to identify weaknesses as the frame of impunity, selectivity and the lack of democracy within the organizations, where the concept should be enforced.
